e-Shakti App – Terms of Use

These Terms of Use (“Terms”) govern your access to and use of the e-Shakti mobile application (“App”). By installing or using the App, you agree to be bound by these Terms. If you do not agree, please discontinue use.

1. About the App

e-Shakti is a wellbeing and mindfulness application that provides:

  • Journaling tools
  • Guided content
  • Soundtracks, exercises, and wellbeing practices
  • Notifications and reminders
  • Mandatory participation in wellbeing research questionnaires during onboarding

The App is not a medical device, does not diagnose conditions, and does not replace professional mental health care.

2. Eligibility

You must be:

  • At least 18 years old, or
  • Using the App under supervision (e.g., as part of a guided or institutional program)

If you are under 18, you must have permission from a parent/guardian or authorised program leader.

3. Account Registration

To use the App, you must create an account using Firebase Authentication.

You agree to:

  • Provide accurate information (name, email, phone number)
  • Keep your login credentials secure
  • Not share your account with others

You are responsible for all activity under your account.

4. Acceptable Use

You agree not to:

  • Use the App for unlawful or harmful purposes
  • Attempt to access accounts or data that are not yours
  • Upload or write content that is abusive, threatening, defamatory, harmful, or illegal
  • Reverse engineer, copy, modify, or exploit the App
  • Interfere with the App’s operation or security
  • Use automated systems (bots, scripts) to access the App

Violation of these rules may result in immediate suspension or termination of your account.

5. Journaling Content (Your Responsibility)

You may write free-text journal entries in the App. You agree not to include:

  • Passwords, OTPs, or security credentials
  • Financial information
  • Government IDs (Aadhaar, PAN, etc.)
  • Personal details of other individuals
  • Highly sensitive medical information

Journal entries remain private to your account unless you explicitly share them elsewhere outside the App.

6. Intellectual Property

All content within the App — including but not limited to:

  • Guided meditations
  • Soundtracks and audio programs
  • Written exercises and tools
  • Graphics, design, and UI
  • App features and structure

— is the intellectual property of Malhar Kedar Bakshi, and/or collaborators where mentioned.

You are granted a personal, non-transferable, non-exclusive license to use the content only within the App.

You may not:

  • Copy
  • Reproduce
  • Redistribute
  • Upload elsewhere
  • Use commercially
  • Create derivative works

without prior written permission.

7. Research Participation (Mandatory)

The App is part of an ongoing wellbeing research project. To access and use the App, you must complete the research questionnaires (such as PRE - Mental Wellness Questionnaire (18-35 Age Group, India) and General Questionnaire for e-shakti app forms) provided through Google Forms.

By installing and proceeding inside the App, you agree that:

  • Completing the required questionnaires is part of the App onboarding process.
  • You must submit the questionnaires using the same email address that you use to log in via Firebase Authentication.
  • The App will not unlock or proceed until the required questionnaires are submitted.

Your questionnaire responses are used for academic and research purposes. For analysis:

  • Your email ID is used only for before–after matching.
  • Research findings are shared only in anonymised or aggregated form.
  • Your identity is never disclosed in research papers or publications.
  • Your journal entries and in-app content are not shared with the research team.

Research participation is mandatory for using the App. If you do not wish to participate in the research component, please discontinue using the App.

8. Push Notifications

The App uses OneSignal to send reminders and updates. You may disable notifications at any time through your device settings.

Notifications are used only for:

  • Practice reminders
  • App-related updates
  • Research communication (if applicable)

No third-party advertising is delivered via notifications.

9. Third-Party Services

The App relies on third-party providers, including:

  • Firebase Authentication (login)
  • Firebase Firestore (journal storage)
  • Firebase Analytics (performance & crash logs)
  • OneSignal (notifications)

By using the App, you also agree to the terms of those services.

10. No Medical or Emergency Support

The App:

  • Does not provide medical advice
  • Does not diagnose or treat mental health conditions
  • Is not intended for crisis situations

If you are in distress or need medical or psychological assistance, please contact local emergency services or a licensed mental health professional.

11. Limitation of Liability

To the maximum extent allowed by law:

  • The App is provided “as is” and “as available.”
  • We do not guarantee uninterrupted, error-free, or perfectly accurate operation.
  • We are not responsible for any loss, damage, or emotional/mental decisions made based on the App’s content.
  • We are not liable for device issues, network problems, or third-party service failures.

Your use of the App is at your own responsibility.

12. Account Suspension or Termination

We may suspend or terminate your account if:

  • You violate these Terms
  • You misuse the app or its content
  • You attempt to interfere with security or data
  • Required for legal compliance

You may delete your account at any time.

13. Data & Privacy

Your data is handled according to the e-Shakti Privacy Policy, which is incorporated into these Terms. By using the App, you also agree to our Privacy Policy.

14. Changes to the Terms

We may update these Terms as needed. When we do:

  • The “Last Updated” date will change
  • Continued use of the App means you accept the updated Terms

15. Governing Law

These Terms are governed by the laws of India, unless your local laws require otherwise.
